SetPerch Privacy Policy

1. Who we are

This Privacy Policy explains how Caperno, LLC, a Minnesota limited liability company ("Caperno," "SetPerch," "we," "us," or "our"), collects, uses, and shares information when you use setperch.com, the SetPerch web application, and related services (the "Service"). It should be read with our Terms and Conditions.

We do not sell your personal information.

2. Information we collect

Information you give us

• Account details: your name, email address, password (stored in hashed form), and plan type
• Payment details: billing name, billing address, and payment card information, collected and processed directly by our payment providers, Outseta and Stripe. We receive only limited details such as the card brand, last four digits, and expiration date.
• Your Content: the spaces, layouts, names, measurements, images, and notes you create or upload
• Communications: messages you send us, such as support requests and feedback

Information collected automatically

• Device and log data: IP address, browser type, operating system, referring pages, pages viewed, and the date and time of your visit
• Usage data: how you interact with the Service, such as features used and actions taken in the app
• Cookies and similar technologies: described in Section 5

Information from others

We may receive information from our service providers, such as payment confirmation from Stripe or Outseta, and sign-in details if you choose to log in through a third-party account.

3. How we use information

We use the information we collect to:

• Create and manage your account and deliver the plan you purchased
• Process payments, renewals, and refunds
• Store, display, and back up Your Content
• Provide customer support and respond to your requests
• Send service messages, such as receipts, security alerts, and changes to our terms
• Send marketing emails about SetPerch, if you have not opted out. Every marketing email includes an unsubscribe link and our physical mailing address.
• Understand how the Service is used so we can fix problems and improve it
• Detect and prevent fraud, abuse, and security incidents
• Comply with legal obligations and enforce our Terms

We do not use Your Content to train artificial intelligence models.

4. How we share information

We share information only as described here:

• Service providers. Companies that help us run the Service, under contracts that limit their use of your information to providing services to us. These include Outseta (accounts, billing, and email), Stripe (payment processing), Replit (application hosting and backend), Cloudflare (website hosting, security, and analytics), and Google Analytics (usage analytics).
• Legal reasons. When we believe disclosure is required by law, subpoena, or court order, or is needed to protect the rights, property, or safety of SetPerch, our users, or others.
• Business transfers. If Caperno is involved in a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction. We will notify you if your information becomes subject to a different privacy policy.
• With your permission. When you direct us to share it, for example by sharing a plan with someone else.

We may share aggregated or de-identified information that cannot reasonably identify you.

5. Cookies and analytics

We use cookies and similar technologies to keep you signed in, remember your settings, secure the Service, and understand site traffic. We use Cloudflare Web Analytics, which measures visits without placing tracking cookies in your browser, and Google Analytics, which does place cookies to measure how the site is used. We do not use third-party advertising cookies.

You can block or delete cookies in your browser settings. If you block essential cookies, parts of the Service, such as signing in, may not work. You can opt out of Google Analytics across all websites using Google’s opt-out browser add-on.

6. How long we keep information

We keep account information and Your Content while your account is active. After you close your account or it is terminated, we delete Your Content within 30 days, except for copies in routine backups, which are overwritten within 90 days. We keep billing and transaction records as long as needed for tax, accounting, and legal purposes.

7. Security

We use reasonable administrative, technical, and physical safeguards to protect your information, including encryption in transit (HTTPS) and access controls. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If we learn of a security breach affecting your personal information, we will notify you as required by law.

8. Your choices and rights

• Account information. You can review and update your account details in your account settings.
• Marketing emails. You can unsubscribe at any time using the link in any marketing email. We will still send service messages, such as receipts.
• Access, correction, deletion, and portability. You may ask us to give you a copy of your personal information, correct it, delete it, or export it. Email setperch.com">privacy@setperch.com. We will verify your identity before acting on a request and respond within the time the law requires.
• State privacy rights. Depending on where you live, including Minnesota, California, and other states with consumer privacy laws, you may have additional rights. These can include the right to know what we collect, to opt out of the sale or sharing of personal information or of targeted advertising, to learn which third parties received your data, and to appeal our decision on a request. We do not sell personal information or use it for targeted advertising. To appeal a decision, reply to our response with "Appeal" in the subject line.
• No discrimination. We will not treat you differently for exercising your privacy rights.

9. Children

The Service is not directed to children under 13, and you must be 18 or older to buy a plan. We do not knowingly collect personal information from children under 13. If you believe a child has given us personal information, contact us and we will delete it.

10. International users

SetPerch is operated in the United States. If you use the Service from outside the U.S., your information will be transferred to, stored, and processed in the U.S., where data protection laws may differ from those in your country.

11. Changes to this policy

We may update this Privacy Policy from time to time. We will post the updated version with a new "Last updated" date and, for material changes, notify you by email or in the Service before the changes take effect.
